{"id":46260,"date":"2025-09-24T16:37:58","date_gmt":"2025-09-24T16:37:58","guid":{"rendered":"https:\/\/buildersmovement.org\/?p=46260"},"modified":"2025-09-24T22:24:14","modified_gmt":"2025-09-24T22:24:14","slug":"free-speech-double-standard","status":"publish","type":"post","link":"https:\/\/buildersmovement.org\/2025\/09\/24\/free-speech-double-standard\/","title":{"rendered":"The Free Speech Double Standard"},"content":{"rendered":"<p><span style=\"font-weight: 400\">In recent weeks, free speech has become a hot topic in America.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Jimmy Kimmel\u2019s late-night show was briefly <\/span><a href=\"https:\/\/www.bbc.com\/news\/articles\/c203n52x1y9o\"><span style=\"font-weight: 400\">suspended<\/span><\/a><span style=\"font-weight: 400\"> after he commented on the political ideology of Charlie Kirk\u2019s suspected killer. The suspension prompted free speech outcries, which were exacerbated by comments from FCC Chairman Brendan Carr. \u201cWe can do this the easy way or the hard way,\u201d he said. \u201cThese companies can find ways to change conduct to take action on Kimmel or, you know, there&#8217;s going to be additional work for the FCC ahead.&#8221; A few days earlier, U.S. Attorney General Pam Bondi <\/span><a href=\"https:\/\/abcnews.go.com\/Politics\/bondi-faces-criticism-doj-target-engages-hate-speech\/story?id=125621716\"><span style=\"font-weight: 400\">sparked outrage<\/span><\/a> <span style=\"font-weight: 400\">(even from many on the right)<\/span><span style=\"font-weight: 400\"> by saying the government should \u201cabsolutely target\u201d people for \u201chate speech,\u201d a statement she later walked back under pressure.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">We all value the First Amendment, but these moments reveal a pattern: government officials using their positions to push against speech they don\u2019t like from the other side. So what counts as \u201cgoing too far,\u201d and who gets to decide? Why does \u201cfree speech\u201d seem to mean one thing when your side is talking, and something entirely different when the other side speaks? And is censorship really the best way to combat ideas we don\u2019t like?<\/span><\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<h3><b>Wielding Government Power to Shut Down Speech<\/b><\/h3>\n<p><span style=\"font-weight: 400\">One of the most persistent myths is that censorship is only a problem on the other side of the political spectrum. In reality, both conservatives and liberals have used government power to try to shut down speech they dislike.<\/span><\/p>\n<p><span style=\"font-weight: 400\">At public universities in states like California and New York, student and faculty protests have led administrators\u2014backed by Democratic-appointed boards\u2014to cancel appearances by controversial speakers such as <\/span><a href=\"https:\/\/www.insidehighered.com\/news\/2016\/02\/24\/cal-state-los-angeles-cancels-conservative-speakers-appearance\"><span style=\"font-weight: 400\">Ben Shapiro<\/span><\/a><span style=\"font-weight: 400\">, <\/span><a href=\"https:\/\/www.thefire.org\/research-learn\/memory-holed-universities-and-internet-speech#:~:text=Peterson%20tweeted%20about%20the%20event,underlying%20constitutionally%20protected%20free%20expression.%E2%80%9D\"><span style=\"font-weight: 400\">Jordan Peterson<\/span><\/a><span style=\"font-weight: 400\">, or <\/span><a href=\"https:\/\/www.cbsnews.com\/sanfrancisco\/news\/uc-berkeley-settles-lawsuit-over-cancellation-of-conservative-speakers-on-campus\/\"><span style=\"font-weight: 400\">Ann Coulter<\/span><\/a><span style=\"font-weight: 400\">. While framed as protecting students from \u201charmful\u201d speech, these are taxpayer-funded institutions, meaning the government was directly involved in shutting down events protected under the First Amendment. (In each case, the university was eventually forced to allow the pundits to speak anyway and sometimes paid fines to campus conservative groups.) Democratic officials in Congress have also <\/span><a href=\"https:\/\/bipartisanpolicy.org\/blog\/summarizing-the-section-230-debate-pro-content-moderation-vs-anti-censorship\/#:~:text=Current%20Discussion%20on%20Capitol%20Hill,regulation%20could%20inadvertently%20stifle%20innovation.\"><span style=\"font-weight: 400\">leaned on tech companies<\/span><\/a><span style=\"font-weight: 400\">, often under the shadow of regulation, to remove political speech considered \u201charmful.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400\">Conservative-led states like Florida and Texas have championed laws restricting what schools and workplaces can teach about race, gender, and history. Florida\u2019s \u201c<\/span><a href=\"https:\/\/firstamendment.mtsu.edu\/article\/stop-w-o-k-e-act-florida\/\"><span style=\"font-weight: 400\">Stop WOKE Act\u201d<\/span><\/a><span style=\"font-weight: 400\"> went so far as to ban certain classroom discussions, until federal courts blocked large parts of it for violating the First Amendment. <\/span><a href=\"https:\/\/www.nytimes.com\/2022\/01\/30\/books\/book-ban-us-schools.html#:~:text=Tiffany%20Justice%2C%20a%20former%20school,for%20that%20kind%20of%20material.\"><span style=\"font-weight: 400\">Book restrictions<\/span><\/a><span style=\"font-weight: 400\"> in school libraries, often targeting titles dealing with racism or LGBTQ identity, are another example of governments stepping in to limit what ideas can circulate.<\/span><\/p>\n<p><span style=\"font-weight: 400\">This isn\u2019t about splitting hairs over what counts as free speech. The bigger problem is the mindset: my side equals freedom, while your side equals oppression. That framing turns free speech into a partisan tug-of-war instead of a shared value.<\/span><\/p>\n<p>&nbsp;<\/p>\n<h3><b>The &#8220;Us vs. Them&#8221; Trap<\/b><\/h3>\n<p><span style=\"font-weight: 400\">Once speech is treated as a political weapon, consistency disappears. <strong>Each side paints itself as the guardian of liberty and the other as the true authoritarians. But when the political winds shift, those roles often flip.<\/strong><\/span><\/p>\n<p><span style=\"font-weight: 400\">In each case, the rhetoric of defending democracy or protecting citizens justified government crackdowns on speech. And in each case, the principle of free expression was sacrificed to the priorities of the moment. <\/span><span style=\"font-weight: 400\"><br \/>\n<\/span><span style=\"font-weight: 400\"><br \/>\n<\/span><span style=\"font-weight: 400\">Polarization intensifies this cycle: the more entrenched we become in our side, the easier it is to dismiss opposing voices not as fellow citizens exercising their rights but as threats to be silenced. And when the other side holds power, that fear flips\u2014we start worrying our own rights could be next on the chopping block. Free speech (and its limits) essentially becomes a weapon in a zero-sum game.\u00a0<\/span><\/p>\n<p>&nbsp;<\/p>\n<h3><b>Who Defines \u201cSpeech\u201d?<\/b><\/h3>\n<p><span style=\"font-weight: 400\">The fiercest battles erupt not only over restrictions but over definitions. Liberals often frame speech they see as causing harm as something the state should be able to limit. Marginalized groups argue that unchecked language can perpetuate systemic harm and oppression, so regulation is necessary.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Conservatives, meanwhile, frequently denounce restrictions as censorship. They argue that the liberal definition of \u201charm\u201d often stretches too wide, labeling speech as dangerous when it may simply be disagreeable. Yet in the aftermath of Charlie Kirk\u2019s assassination, some Republicans <\/span><a href=\"https:\/\/www.cbsnews.com\/news\/trump-charlie-kirk-free-speech-first-amendment\/\"><span style=\"font-weight: 400\">called for investigations<\/span><\/a><span style=\"font-weight: 400\"> into journalists and activists they accused of using harmful language. In other words, politicians who often criticize \u201cwoke silencing\u201d were, in this moment, calling for state-led consequences against dissent.<\/span><\/p>\n<p><span style=\"font-weight: 400\">These shifting definitions reveal a hard truth: they aren\u2019t neutral. They\u2019re shaped by power, history, and lived experience\u2014and they change depending on whose side of the field the ball lands.<\/span><\/p>\n<p>&nbsp;<\/p>\n<h3><b>Breaking Out of the In-Group<\/b><\/h3>\n<p><span style=\"font-weight: 400\">All of this gets filtered through partisan media, which magnifies the sense of grievance. Conservative outlets spotlight examples of Democratic-led crackdowns, like the California misinformation law or campus speech codes. Liberal outlets focus on conservative-led restrictions, such as book bans and Trump\u2019s lawsuits against reporters.<\/span><\/p>\n<p><span style=\"font-weight: 400\">The result is a nation where both sides are convinced that free speech is only under attack from their opponents. Each side feels like the victim, and neither sees its own role in undermining the principle.<\/span><\/p>\n<p><span style=\"font-weight: 400\">If free speech is only defended when it benefits your team, then it\u2019s not really free speech. The true test is whether we are willing to protect speech we hate.\u00a0<\/span><strong>Would you still defend free expression if it were your opponent\u2019s rally, your opponent\u2019s book, or your opponent\u2019s joke? If the answer is no, then what you are defending isn\u2019t free speech\u2014it\u2019s just team loyalty.<\/strong><\/p>\n<p>&nbsp;<\/p>\n<h3><b>The Best Way to Fight Ideas You Dislike<\/b><\/h3>\n<p><span style=\"font-weight: 400\">At its best, speech should serve as a bridge rather than a weapon. That doesn\u2019t mean offensive ideas deserve applause. It means the best way to fight bad ideas is through better ones, not through government bans.<\/span><\/p>\n<p><span style=\"font-weight: 400\">The Kimmel controversy makes this clear. The issue isn\u2019t whether his comments crossed a line. The real issue is how we choose to respond. Do we demand lawsuits, censorship, or government investigations? Or do we push back with more speech, more debate, and more dialogue?<\/span><\/p>\n<p><span style=\"font-weight: 400\">Free speech has always been messy, but it only works if it\u2019s consistent. If we want it to mean anything at all, we have to defend it vigorously\u2014even when it stings.
